Heard back from ICSTIS today about my complaint .
They have ruled that ” the message should have informed recipients that calling the 090 number would cost more if called from a mobile telephone. The service was considered to be a competition and therefore failed to fulfill certain requirements of the ICSTIS Code, for example the text advertisement did not state any significant terms and conditions. Furthermore, the recorded message (upon connection to the 090 number) appeared to contain, what the ICSTIS committee viewed as unnecessary information that is a breach of ‘delay’ under the ICSTIS code. As a result of the breaches the service provider has been barred from operating this service and will have to pay for the cost of our investigation”.
What a result (for once!) They tell me they don’t have a compensation scheme, but the again I wasn’t daft enough to ring the line in the first place, but they did tell me that Daniel Summerfield, Los Clevelescars, La Carla, Mijas Costas, Malaga, Spain is the scumbag who ran the service (although they didn’t use quite those words). I’d be very suprised if anyone managed to get money out of him from the uk.
Their other advise is to register the mobile with the TPS and then contact the OIC on 01625 547000 to register a formal complaint (which is what I did)
